If my water heater is in a common area and causes damage to a neighboring unit, am I responsible for damage?

I live in a condo and my water heater is in a closet (along with my neighbor’s water heater) in a common area between the condos. If my water heater leaks and causes damage to my neighbor’s condo, am I liable for damages?

    I also live in a condo with the same set up. You didn’t say if you rent or own. Either way, you should both have insurance, homeowners or renter’s.

    Technically, she could sue you for damages, but hopefully you can stay on good terms. Your insurance should cover any damage to both units, or she could put the claim on her policy.

    Now is the time to be a good neighbor, be apologetic and helpful. This happened to me, and my neighbor filed her own claim.
