why should you have to pay higher insurance because he doesn’t have any? that’s what courts are for.
File a claim with your insurance and get it taken care of right away. Let them go after the neighbor in court so you can get back to watching tv. If they want to increase your premium then get on the phone and call around and get a new insurance quote, then get on the phone with the insurance you currently have and tell them you have a quote and you arent affraid to leave them. If they dont cave in and drop the premium then switch.
If there is a condo association take it up with them. Most have insurance requirements. Your insurance should pay for the damage and they can sue your neighbor.
Normally, the Condo Association has insurance on the building, including the units. And their insurance is primary, meaning that even if you also have insurance that theirs will pay the claim first. Your homeowner insurance will kick in for items that are not part of your unit. Obviously, this will be any personal items, but can also include carpeting.
