			<content:encoded><![CDATA[<p>We live in a condo, upstairs. Our insurance will cover any water damage done to my neighbor below but will it cover damage to our bathroom? We may have a leak behind the wall where the shower is. Possibly a faucet. Will have it repaired tomorrow but what if the damage behind the walls is extensive in our bathroom. Will most insurances cover it? We have a renters type that covers the inside of the condo, we own our condo but the insurance is essentially the same type as renters, and any liability to other units. Any damage caused by a leaky roof or something would be covered by the property management insurance.</p>

			<content:encoded><![CDATA[<p>I live in a condo.  my master bedroom got flooded from water damage caused by water coming out of the shower drain and toilet.  My insurance decided that they will not cover it because of an eclusion in the policy stated they don&#8217;t cover water damage caused by sewer backup or drain backup.  The problem happened when the pipe in the building somewhere burst.  They called the plumbers.  Plumbers turned off the water.  when they were finished, they turned the water back on and all the water started flooding in my bathroom and into the bedroom. They turned the water back off  and rotted out the drain or pipe in the building and found a lot of junk that somebody had flushed down the toilet and they said that this was the cause for the flooding in my unit.  So my insurance isn&#8217;t covering it.  Who should I go after now?  Should i go after my condo association or go after the plumbers who came to work on the problem?  Or should I sue my insurance company.  somebody has to pay!! and it&#8217;s not going to be me!!</p>

Thanks for the feedback so far.  As an additional note, I&#8217;d like to add that the roofers had completely stripped all of the roofing materials, down to a single ply of wood boards with noticeable gaps.  A tarp was then pulled over the entire condo for the weekend, which a storm blew completely off before the downpour began.  It was literally raining INSIDE my house for over an hour.  Yes, I need to buy the right insurance next time, but is there not a responsibilty of the Roofing Company to square things up with me?</p>

I live in a condo in Houston. My condo is on the 2nd floor of a 3-floor building. As you know, Hurricane Ike swept houston area. The roof of the 3rd floor condo above me was damaged and rain poured in the 3rd floor condo, and water leak through my ceiling. I do not have personal insurance plan. I now have moved out and don&#8217;t know what I can do. Our condo HOA has a master insurance policy which should cover all exterior part of the condo.  At this time, I could not locate the insurance policy. I do not know if the insurance will cover the internal part of my condo, such as the internal part of the wall and ceiling because all these damage are due to the damaged roof?. If not, should my neighbor live in the condo above me be responsible for my repair since the water came down from their condo?<br />
I know it is a tough time for all us .I really do not know what I can do.  Thanks in advance for any advice.</p>
<p>I like rlucas&#8217;s answer &#8220;The damage was caused by the condo association property failing.<br />
The Master policy of the HOA should cover the cost of the repair. &#8221;<br />
Since it was caused by condo association property failing, I think the master policy&#8217;s libility should cover my repairment, at least of my ceiling. Does it make sense?</p>

			<content:encoded><![CDATA[<p>Our ground floor condo was damaged badly by water down pouring from a malfunction washer machine upstairs.  Our guest reported when it happened early Saturday morning, we called the management company who manages the unit upstairs.  The property manager came out, looked around and decided that the washer was fine, he ignore my guest&#8217;s comment &#8220;it is the washer machine, I smelled laundry detergent&#8221; completely.  In the early afternoon, right after our guest clean up water on our floor, water poured down again due to the renter&#8217;s running washer.  We had to call 911 (we are 300 miles away) to get police officer out there to stop the renter upstairs from running her washer.  We called our HOA, our HOA management called a plumber in.  Plumber cut out a hole in our ceiling and found it was not a pipe problem, again, the plumber could not access the upstairs unit until Sunday close to noon.  The plumber wrote a report about the cause, was the washer on<br />
Sunday.  Long story short, the owner&#8217;s insurance company came out and decided that they are not going to pay for anything.  Our insurance company would not pay for it because the upstairs owner does have policy.  We are left with thousands of dollars of mitigation and repair fees.  Our HOA advises us that by law, it is the responsibility of the owner of the unit above us.  We have no idea of how to pursue this issue.  Any advices are appreciated.</p>
