Are you telling me the inside temperature of the condo unit dropped below freezing? I am sorry but I don't buy that period. Not only would the heater need to be off but the windows would need to be open too.

You pay for the damage. I don't buy what you were told and you should not buy it either.

Well if you could prove the damage was caused directly from the low temps then the tenant would have to pay. Too bad that will be hard to do. Any smart landlord would have better insurance.

You should pay for fixing the pipe and any water damage to the apartment itself. Your tenant should pay for any water damage to his or her personal property such as furniture or whatever.

You don't have household insurance on your property? You should go out and buy some (although it wouldn't cover broken pipes anyway). I've seen this before and I've seen the landlord have to repair the structure but not anything that was damaged from the water AND I've seen the tenant be responsible for everything because the law says you have to write problems down and give it to your landlord in order to have a case.

I would say the tenant should be responsible.
